Agency Relationships
California law requires real estate agents to give you a written “Disclosure Regarding Real Estate Agency Relationship” (Civil Code §2079.16) as soon as practicable, and before you sign a listing agreement or purchase offer. In summary:
- Seller’s agent: owes the seller fiduciary duties of utmost care, integrity, honesty, and loyalty.
- Buyer’s agent: owes the buyer those same fiduciary duties.
- Every agent, to both buyer and seller: reasonable skill and care, honest and fair dealing and good faith, and disclosure of all known facts that materially affect the value or desirability of the property and are not known to or readily observable by the other party.
- Dual agent: one agent may represent both buyer and seller only with the knowing, written consent of both. A dual agent may not tell the buyer the seller will accept a lower price, or tell the seller the buyer will pay a higher price, without express permission.
Read the full disclosure text in Civil Code §2079.16 and consumer guidance from the California Department of Real Estate. Contacting us through this site does not create an agency relationship. One is formed only by a written agreement.
Equal Housing Opportunity
We are committed to the letter and spirit of U.S. policy for achieving equal housing opportunity throughout the nation. We encourage and support marketing programs in which there are no barriers to obtaining housing.
We do not discriminate in any real estate service on the basis of race, color, religion, sex, disability, familial status, or national origin, as protected by the federal Fair Housing Act, or on the basis of ancestry, marital status, sexual orientation, gender, gender identity, gender expression, source of income (including housing assistance), genetic information, military or veteran status, age, medical condition, citizenship, primary language, immigration status, or any other basis protected by California law, including the Fair Employment and Housing Act and the Unruh Civil Rights Act.
If you believe you have experienced housing discrimination, you may file a complaint with the U.S. Department of Housing and Urban Development or the California Civil Rights Department.
